Beverly Hills Guns Sales and Cancellation Policy
We appreciate your business!
ALL SALES ARE FINAL, except for rights and refunds required by law or an express written return policy. Change-of-mind cancellation after the statutory waiting period requires Beverly Hills Guns' written approval. Manufacturer warranty service remains subject to the manufacturer's terms.
DURING THE WAITING PERIOD: If the buyer cancels a non-special-order firearm purchase during the statutory 10-day waiting period under California Penal Code section 26815, all restocking and other return-related fees combined will not exceed 5% of the firearm purchase price under section 26883(a). This is a maximum, not a government-required charge. Shipping, handling or other store charges will not be added to evade this combined limit.
AFTER THE WAITING PERIOD AND OTHER BUYER BREACH: The 5% waiting-period limit does not govern a cancellation requested after that statutory period expires. Where Beverly Hills Guns justifiably withholds delivery because of the buyer's breach, restitution is governed by California Commercial Code section 2718. A valid agreed liquidated-damages provision governs where enforceable under Civil Code section 1671. In the absence of such terms, section 2718(2)(b) provides for restitution of payments exceeding 20% of the value of the total performance for which the buyer is obligated under the contract or $500, whichever is smaller. Section 2718(3) permits offsets to the extent we establish a right to recover other damages or the value of benefits received by the buyer. This is not an automatic 20% fee for every cancellation. Applicable law and any binding agreement providing greater refund rights control; amounts will not be counted twice.
SPECIAL ORDERS: Under Penal Code section 26883(c), a special order is a specific request by the buyer that we order a firearm unavailable to us. A firearm is not automatically a special order merely because it ships from a distributor. Section 26883's 5% limitation does not apply to a qualifying special order. Any special-order cancellation amount must be disclosed and agreed as part of the purchase contract before ordering and must be enforceable under applicable law. Without enforceable agreed cancellation terms, the applicable agreement and California law, including Commercial Code section 2718 where its conditions are met, govern. There is no automatic 50% special-order fee.
DOJ DENIAL OR OTHER NON-DELIVERY: We cannot deliver a firearm when prohibited by law. A denial or other inability to deliver does not automatically establish buyer breach or authorize a percentage deduction. Any refund or retention is determined under the applicable agreement and law.
FEES AND TAXES: Government DROS/background-check fees already submitted and completed FSC testing or certification services are separately itemized and retained only to the extent permitted by law. Unused charges and unperformed services are not automatically non-refundable. Required tax reversals, merchandise refunds and permitted deductions are itemized. Store charges are not government fees. Private Party Transfer charges remain limited to those permitted by law.
REFUND METHOD: Card refunds ordinarily return through the original payment processor; another method may be used when agreed with the customer and permitted by the processor and law. The credit memo records the refund method and payment reference. Confirmation does not guarantee that the bank has finished posting the funds.
POLICY EFFECTIVE DATE: October 27, 2026. These terms apply prospectively and do not amend earlier purchase agreements or establish terms previously presented or accepted.
